Your agreement with VaraVild
These are the Terms & Conditions for registering and participating in a course or event, hereafter called: "course", provided by VaraVild EF, Höstsätern Sätervägen 14, 790 91 Idre, Sweden, hereafter called: "VaraVild".
Please read these Terms & Conditions carefully before completing a registration. Once a completed registration form and specified payment or deposit have been received by VaraVild all persons named on the registration form, hereafter called: "participants", will have entered a binding contract on the basis of these Terms & Conditions. This agreement is governed by Swedish law. Please contact us if you have any questions.
If you register multiple participants VaraVild will consider the registration a single group registration and you will receive all correspondence from VaraVild including invoices.
Participants who can not legally enter a binding agreement such as persons under the age of 18 must be accompanied by an adult participant that can enter the agreement on their behalf and take full responsibility.
If you register multiple participants you must make sure all participants get to read and consent to these Terms & Conditions before completing the registration.
Agreement on the basis of these Terms & conditions arises on fulfillment of all of the following:
- receipt by VaraVild of a properly completed registration form
- receipt by VaraVild of the payment or deposit specified
- clearance of the payment or deposit into VaraVild's bank account
- acceptance by VaraVild in writing
VaraVild reserves the right, in its absolute discretion and without having to give reasons, to refuse to accept a registration. If VaraVild chooses to do so no agreement arises and any payment accompanying the registration will be returned.
The agreement is between VaraVild and the participants and is the sole agreement between those parties.
2. Conduct of the course
The participants acknowledge that during a VaraVild course they are required to submit to the reasonable instructions and leadership of VaraVild. The participants acknowledge that persons attending a VaraVild course are entitled to expect a high standard of conduct and regard for personal well being on the part of all participants.
For this reason the participants accept that VaraVild may, in its absolute discretion and without the need to give reasons, arrange for them to be removed from a course, if necessary against their will, without being liable for any losses resulting from the removal. The participants will on demand reimburse VaraVild its costs resulting from their removal. Circumstances which may result in removal include (without limitation) intoxication; disorderly or abusive conduct; failure of control over minors; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course.
If the course is due to start in 8 weeks or less full payment is required and no deposit is taken.
If the course is due to start in more than 8 weeks, you will be invoiced for 20% of the course fee. You will be sent an email reminder at 9 weeks prior to the start date of the course prompting you to pay the remaining 80%. The balance must be paid in full 8 weeks prior to the start date of the course. If not so payed, VaraVild reserves the right to treat the agreement as canceled by the participants and the participants will forfeit their 20% deposit.
As email is not guaranteed to be delivered it is ultimately your responsibility to check when payments are due.
4. Changing a course date
In the case the participants wish to change the date of their course and places are available, an administration fee of SEK 300 (including VAT) will be charged for the transfer.
5. Cancellation by participants
If the registration is canceled by the participants, for any reason, the following cancellation charge will arise:
- Cancellation more than 8 weeks before the course start date: 100% of the deposit is payable but any final payment will be refunded.
- Cancellation less than 8 weeks before the course start date: 100% of the fee is payable.
The participants acknowledge that such penalties are reasonable to arise in view of the fact that VaraVild needs to prepare for a course substantially in advance of the course.
6. Cancellation by VaraVild
In the event that VaraVild is forced to cancel a course due to underbooking, VaraVild will inform the the participants not later than 15 days before the course start date and offer a transfer to an alternative course date if possible. If no alternative can be found or the participants refuse transfer, VaraVild will refund 100% of the amount received.
In the event that VaraVild is forced to cancel a course due to circumstances beyond its reasonable control participants will be offered a transfer to an alternative course date if possible. If no alternative can be found or the participants refuse transfer, VaraVild will refund 100% of the amount received.
7. Modification of course itinerary
VaraVild courses are exposed to natural variables and local regulations such as the weather and local fire hazard regulations. Situations may arise forcing VaraVild to modify a course itinerary at short notice. Likewise, VaraVild, may decide to do so in order to specifically take advantage of natural circumstances. The participants acknowledge that because of the unpredictability of nature it may be reasonable to modify a course.
VaraVild advises participants to make sure they are adequately insured when they participate in a course.
VaraVild also advises participants to purchase a cancellation insurance.
VaraVild courses take place in the wilderness and are by their very nature not free from hazards. Consequently, the participants acknowledge that there are circumstances in which an accident could befall participants without VaraVild being at fault and realize that they are taking part in a VaraVild course at their own risk.
In the unlikely event that participants have cause for complaint about a VaraVild course, complaint should be made to a representative of VaraVild during the course, in order that, if needed, the complaint can be addressed. The participants acknowledge that it is unreasonable to take no action during a course but to complain later. However, if a problem can not be resolved, complaint should be made in writing within 14 days after the course ended.
